CADP一直注意搜集中国的死刑案例,通过为死刑案件的被告人提供法律援助、组织死刑案件研讨会和废除死刑理念的研讨会、撰写中国年度死刑报告和制作死刑案件的纪录片等形式,在中国推广废除死刑的理念。


近几年来,CADP工作重点是在律师中间推广废除死刑的理念。因为,中国“杀人偿命,欠债还钱”的历史传统和统治集团对死刑正当性的刻意宣传,使得中国民众,包括大多数律师,对死刑一直采取忽视或支持的态度。许多律师在代理案件的时候或多或少都会接触到死刑案件,因此,他们对待死刑案件的态度和辩护的策略,往往会直接决定被告人的生命。


CADP理事会成员主要由中国着名的维权律师组成。我们联络律师,组织律师召开研讨会,在律师中间推动废除死刑的理念具有得天独厚的优势。


2011年和2012年的年底,我们分别举办了CADP的第一届和第二届年会,参加的人员主要有中国的律师、记者、国内外的学者和其他NGO的成员。年会以推动在中国废除死刑为主旨,结合个案,在律师中间进行深入探讨。


在中国民间社会面临的巨大压力的情况下,CADP依然完成了2011年的中国死刑状况报告,我们希望将这项工作持续下去。


CADP目前更多的工作在于支持律师对死刑案件进行法律援助,为本不应判处死刑的被告人提供辩护。近两年,我们介入了十几起死刑案件的援助工作,有三起案件,涉及四个被告人,法院改变了原来的死刑判决;有一起案件,法院重审之后,改判被告人无罪释放;但也有几个案件,我们无奈地看到最高人民法院核准死刑,被告人被执行死刑;也有几个案件我们一直在努力,推动法院重新审判,改变原有死刑缓期执行的判决。


CADP在支持律师代理死刑辩护的同时,也安排摄影师记录律师办案过程,搜集整理案件资料,制作了纪录片。


CADP也支持律师通过自媒体,介绍自己办理的死刑案件,推广废除死刑的理念。


CADP联络汇集了中国几乎全部的维权律师,在推动在中国废除死刑理念的同时,也在维护中国的基本人权、建设中国的民间社会和推进中国的民主法治进程。

China Against Death Penalty ( CADP) is the first NGO that aims at promoting the abolition of death penalty in mainland China. It is initiated by famous Chinese human rights lawyer Teng Biao.

CADP aims at abolishing death penalty in China, through legal aid, discussion conferences, citizen education, documentary and movie-screening, most importantly, we will do our independent researches through collecting and analyzing specific death penalty cases in China and give annual reports on Death Penalty in China. In addition to that, CADP will also take an active part in correcting wrongly-sentenced death penalty cases through our legal aid program. promoting legal reform and ultimately abolish death penalty in China.


Promoting the Abolition of Death Penalty in the Chinese Civil Society

From a global perspective, most countries have already abolished the death penalty, whether legally or de facto. However, China is the country that uses capital punishment most frequently. Based on the statistics supplied by Amnesty International, at least seventy percent of the capital punishments are executed in China. This number could be much higher, up to ninety percent, according to other scholars’ research result. In Chinese criminal law there are at least 68 capital offenses (13 of which has been abolished recently), violent or nonviolent. From the cases that are exposed in domestic media, several people who were convicted, even executed, turn out to be innocent, such as Nie Shubin in Hebei Province, Teng Xingshan in Hunan Province, HugeJiletu in Inner Mongolia, Zhao Zuohai in Henan Province and etc.

Abolishing death penalty conforms to international demand for human rights, and the humanitarian concern in the criminal justice system. According to the experience of a number of countries around the globe which have already abolished death penalties , this work requires great efforts ranging from legal, political, cultural and ideal front, long-time communication of ideas and thoughts, and specific social movements. It also requires us to start working when most of the people in the society still cannot accept the idea of abolishing death penalty.

There are more and more academic studies on death penalty in China, however CADP emphasizes social action rather than academic research alone. We possess rich experiences in legal action, media publicizing and social action, and have won considerable social influence in the Chinese society. Our previous work includes utilizing academic achievements to promote positive changes in lawmaking and relevant policies on human rights protection.

To abolish death penalty in China requires long-term commitment, yet there are some pressing work needs to be addressed. For instance, The Open Constitution Initiative (OCI) and the initiators of CADP are providing legal aid to the Chen Guoqing case in Hebei Province; Huang Zhiqiang case in Jiangxi Province; Gan Jinhua case in Guangdong Province; Lin Ruiqiang case in Guangdong Provinces and many other obviously wrongly-sentenced death penalty cases. In all these cases, the accused were forced to plead guilty under extremely cruel torture, but the court made the decision despite various defects in the evidences. In the next three years, we can, by means of legal aid to some typical wrong death penalty cases and by educating the public, promote the idea of anti-death-penalty, and promote more prudence in the death sentencing, and achieving the goal of creating a ground for the society to reflect upon the use of death penalty, and nearly no death penalty in non-violent cases.

Our Main Activities:

■Legal aid:
Providing legal defense or legal aid to the defendants in death penalty cases, especially in cases that are wrongly sentenced, that involve the use of torture or that have procedural defects, or that in which the defendant suffers from mental illnesses.

■Research report:
Carrying out independent research on the issue of the abolition of death penalty. Current research projects include: the implementation of Supreme Court’s withdrawal of death penalty review power; research on non-violent crime death penalty the causes of wrongly-convicted death penalty cases and other ordinary death penalty cases. We will write a series of “China Death Penalty Annual Report” to summarize and analyze the fundamental data on Chinese death penalty situation, report the specific legislative, judicial reforms on death penalty in China, and present our legislative and policy suggestions.

■Citizen education
Cooperating with the media, we plan to carry out discussions or debates on the abolition or moratorium of death penalty. We will educate the public on the issue in the form of discussing conferences, documentaries, movie-screening and public debates. We will edit, translate, publish related research reports, brochures and media works.

■Professional website:
Build a professional website on the issue of death penalty, collect and publish research reports, death penalty cases, papers, and news on China’s legal reform in this area and international legal news related to death penalty.
